WHAT IS AN EXPUNCTION?

An expunction allows individuals, in certain circumstances, to have specific arrests or convictions erased from their arrest record and removed from public availability. This means it will no longer show up in background checks. This means you can deny ever having been arrested or charged for that mistake. This means you can stop being held back.

 

CAN I GET MY RECORD EXPUNGED?

In general, arrests that do not lead to a conviction or are never charged may be eligible for expungements. While this is a good guideline to start with, every case is different, and does not guarantee that such a record is eligible for expunction.

However, there are specific crimes that if committed while underage (for example: minor in possession, a truancy charge, etc.) have the ability to be expunged in certain situations where an offender hasn't committed any crimes for a specific period of time afterwards.

 

WHAT IF MY RECORD CAN't BE EXPUNGED?

If your record can't be expunged, there may still be the possibility of an order of non-disclosure. An order of non-disclosure seals the records from the public and most background checks, but still makes the record available to entities such as law enforcement. While the record is not completely destroyed, you are still entitled to deny the arrest and the prosecution of that charge, so that you may find employment freely without that charge hanging over your head for regular background checks.
